First instance body dealing with electoral disputes

مادة (34) :

يحق لكل ذي مصلحة من المرشحين أن يطعن علىنتائج الانتخابات أمام اللجنة الرئيسية خلال عشرة أيام من تاريخ إعلانهابمكتب الوالي , على أن يتضمن الطعن الأسباب التي يستند إليها والمستنداتالمؤيدة له ، ويعطى إيصالاً بذلك .

وتقوم اللجنة الرئيسية فور استلام الطعنبإحالته إلى لجنة الفصل في التظلمات والطعون الانتخابية التي يتعين عليها البت فيهخلال مدة لا تتجاوز ثلاثين يوماً من تاريخ قفل باب الطعن ، وتكونقراراتها نهائية غير قابلة للطعن فيها بأي طريق من طرق الطعن.

وإذا قررت لجنة الفصل في التظلماتوالطعون الانتخابية بعد نظرها للطعون بطلان نتائج أحد أعضاء مجلس الشورى يحل محلهالتالي له في عدد الأصوات من تاريخ صدور قرار بطلان النتائج

Article(34)     

Each candidate has the right to contestthe validity of the voting/elections results and shall submit his/her contestto the Central Elections Committee within ten days from the date of declarationof results at the Wali's Office. The contest application should include reasons and justifications uponwhich he/she has based his/her contest. The committee shall look into thecontest and evaluate it and issue its decision within 30 days starting from theend of complaints period. Its decision is final and not subject to any appeal.If the committee decided to cancel the election, the next winning candidate inthe list replaces the winning candidate.
