DEC: Article 21.e) on the basis of an application/complaint (if such application/complaint isfiled in consistent with the procedure and within the timeframe prescribed bythe present Law) or at its own initiative, examine the lawfulness of theactions and decisions made by PECs on the Election Day, as well as by theappointed official (including the accuracy of the registration of electionparticipants, counting of ballot papers, etc.), and if violations are detected,make appropriate decision (includingchanging of data of the PEC summary protocol of polling results in accordancewith the examination outcome or annul the polling results in the pollingstation). If the violation results into the replacement of an elected individual in asingle-mandate district or of any candidate participating in the run-off, or areplacement of an individual elected in a multi-mandate district (whenholding elections for local self-government bodies), or change of a decision whether to deem the electionsvalid or not (by majoritarian election districts and for elections oflocal self-government bodies), and if such an examination is not sufficient forthe DEC to establish the lawfulness of the results, the DEC shall make a decision to render thepolling results in the relevant election precinct null and request the CEC toset the date for the repeat voting. In case of a DEC decision onrecounting of votes, it shall notify thereof all election subjects and observerorganizations, representatives of which attended the ballot paper counting at aparticular precinct and, if requested, ensure their attendance during therecounting process
CEC: Article 14.j) by its own initiative or on the basis of an application/complaint, inaccordance with the procedures for examining election disputes defined by thepresent Law, check the legitimacy of the decisions and acts of the electioncommissions, their officials and, in the event of violation, invalidate or revise them by anordinance; by an ordinance, make a decision on opening the parcelsreceived from the respective PEC and on recounting of ballot papers/ lists of voters. Incase of recounting ballot papers, the CEC shall notify all contestants andobserver organizations, whose representatives attend the counting process atthe election precinct, and based on their will, ensure the presence of theirrepresentatives during the recounting process;
