2 Treaties amending orreplacing TEU or TFEU

(2) The referendumcondition is that—

(a) the Act providingfor the approval of the treaty provides that the provision approving the treatyis not to come into force until a referendum about whether the treaty should beratified has been held throughout the United Kingdom or, where the treaty alsoaffects Gibraltar, throughout the United Kingdom and Gibraltar,

(b) the referendum hasbeen held, and

 

(c) the majority ofthose voting in the referendum are in favour of the ratification of the treaty.

Comment

For optional referendums: Political Parties, Elections and ReferendumsAct of 2000 provides the legal framework under which national and/or regionalreferendums may be held. Nevertheless, parliament must pass a specific law ineach instance in order for a referendum to be held. Requirements forreferendums may be provided in this specific law.
