Constitutional Court strikes down controversial provision criminalizing ‘false information’
On 25 November, Mongolia’s Constitutional Court struck down Article 13.14 of the Criminal Code, which criminalized ‘the dissemination of false information,’ declaring it unconstitutional. The case was brought forward with the support of journalists, lawyers and civil society groups. The ruling is effective immediately and suspends the provision, however the Mongolian parliament must formally accept the verdict for its full repeal. Rights experts note that the decision marks a major victory for press freedom and free speech, since the law had increasingly been used to silence journalists and critics in recent years. It remains to be seen when parliament will approve the verdict.
