Section 12 of the Elections Ordinance (as of December 2014) provides only for the registration of some groups of foreign residents, but not for their vote in the elections. Section 40 (Where voters shall vote) does not contain any provisions related to voting outside the islands. The amendments to the legislation up to 2020 have been checked and no changes were found in regards to external voting.

Registration of electors resident overseas

12.  (1) This section applies to a person—

(a) who is qualified to be registered as an elector, and

(b) who, at the time when the person makes an application for registration, is resident outside the Islands for a reason mentioned in subsection (2).

(2) The reasons are—

(a) the person is a member of Her Majesty’s Forces;

(b) the person is working abroad on Government business;

(c) the person is a student resident abroad.

(3) An application for registration must—

(a) be in the form set out in Form 1 in Schedule 1, and

(b) be signed by the applicant in the presence of a Notary Public (or other official exercising functions corresponding to those of a Notary Public) in the territory or country where the person is resident.

(4) The person must send the completed application to the Supervisor along with such documents as the Supervisor requires to establishing the person’s qualification to be registered.
